Reason Apple Cannot Restore TikTok to the App Store

Though the U.S. TikTok ban was brief, the app is still missing from the Apple App Store. After the ban was lifted, many users expected it to return right away, but that has not happened. According to a legal expert, Apple may be under restrictions preventing them from reinstating the app just yet.

Why Apple Hasn’t Restored TikTok to the App Store

For those with TikTok already installed on their iPhones, the app is still working, according to Phone Arena. But newbies who want to download it from the App Store aren't able to right now. It's increasingly been asking questions about Apple's role in enforcing local legal decisions regarding Internet access.

According to Apple, it took the decision to remove TikTok to abide by the laws in the regions in which it operates. Since the U.S. government has since clarified that the ban will not be enforced, Apple has not decided to reverse its decision. Before actually restoring the app, the company may want additional legal assurance that it doesn’t have to relinquish ownership back.

That could be one of them: the legal complexity of the ban and the reversal that followed it. While Oracle has brought service back for TikTok, Apple works in a different regulatory landscape. So it might be waiting for formal approval, or additional legal clarity before bringing back the app on its platform.

Until Apple gets official word that restoring TikTok will not invite legal repercussions, the app could not be downloaded. Why Apple Is Hesitant to Restore TikTok

Apple apparently is holding off, as the U.S. government has assured them that the ban won’t be enforced, and they are apparently waiting for a final legal resolution. Immediate reinstatement under the circumstances is a risky move, because of the uncertainty over the legality of Trump's order.

But Rozenshtein said Apple’s slow and cautious response was not only necessary but justified, as the executive order could still face legal challenges. If a subsequence court upholds the ban, then Apple could be forced to face issues by reinstalling the app before the ban is upheld. Google and Microsoft appear to be following the same strategy.

One of the greatest concerns is that a promise to not enforce in and of itself does not provide legal protection. Rozenshtein noted that such pledges are normally not considered binding by courts. That could mean even if their use of them were within the law, companies still could face legal consequences if the ban is later found to be valid.

It’s the safest course for Apple to wait and see before taking any more definitive legal action. The company wishes to operate in strict compliance policies and does not want to take any chances running afoul of any of existing or future rulings. Restoring TikTok early could bypass the legal trouble that comes with it.

Until the legal matter is fully resolved Apple is unlikely to be reinstating TikTok on to the app store. The executive order's legality is in question in courts and users who would like to download the app may be forced to wait until the courts make a decision.

Apple’s Risk in Restoring TikTok

To Apple, the financial risks are high. When a ban like this can have such massive repercussions as non-compliance with government orders, things might get a little hot. So even the largest of tech companies like Apple must carefully consider these risks when making a decision.

Considering those red herrings, we suspect that Apple will permit TikTok to return only as a more definitive legal decision is reached. In the meantime users will need to wait patiently to download the app from the App Store.
