Supreme Court Asked to Review TikTok Ban Law by Trump

President Donald Trump has called on the US Supreme Court to pause applying a law that could effectively block TikTok or compel its sale to American buyers. Trump said that he wanted some time once in office to try to seek a “political solution” to the problem, stressing on the consequences of the platform’s presence in the United States.

Supreme Court to Review TikTok Ban as Trump Calls for Delay

The arguments are to be held before the Supreme Court on January 10. The law was approved by Congress in April and set January 19 for ByteDance, TikTok’s owner, to sell the app or be banned across the United States. This time line provides little latitude for negotiation before a transition in the administration of the country.

The social media application with the tagline Get TikTok, has over 170 million users in the United States, and the platform is not relenting in efforts to sue to set aside the law. Through its complaint it alleges that the measure is unconstitutional, and discriminates against it due to its origin from China. Should the Supreme Court go against TikTok and divestment does not happen, the app can be blocked a day before Trump takes oath.

This makes Trump’s call for a delay a stunning about-face from his 2020 campaign to either ban the app or force ByteDance to sell off its subsidiary to a domestic company, on the grounds of national security risks. His current position speaks to the fact that the nature of the issue has grown from a simple head scratcher about privacy into a heated political controversy over data privacy, trade, and freedom of speech.

The case also shows continuity of tensions in the US-China relations around technology and security, as the actual threat posed by the extremely popular platform is challenging to regulate. As a result hundreds of millions of users are at risk and outcomes of the Supreme Court can define directions of the development of the legislation of the digital privacy and relations between countries in the future.

Trump Urges Supreme Court to Delay TikTok Divestment Deadline

President-elect Donald Trump has now formally asked the U.S. Supreme Court to suspend the date set by lawmakers for TikTok to sell its company by January 19, 2025. Trump’s lawyer, D. John Sauer, pointed out that Trump is not expressing any opinion, legal or otherwise, as to the merits of the matter, but is requesting additional reasonable time to resolve it politically once he takes the oath of office.

The law at issue wants TikTok’s Chinese owner ByteDance to divest the app to an American firm or risk being shut down in the United States. According to Sauer, to pass over the enforcement of divestment, the incoming Trump administration would prefer a diplomatic or political resolution, which would be impossible if the deadline is moved ahead fast.

This request is the latest sign of ByteDance’s frantic attempts to get through to Trump and his team during the presidential campaign as the firm does not want to be banned, given that it has 170 million users in the United States. ByteDance however continues to justify that the law compromises its ownership and infringes on constitutional provisions.

The result of the Supreme Court on whether or not it will grant a stay on the injunction will largely determine the future of TikTok in the United States of America. If no solution is found and if divestment is not done then all over chances of banning this app is always present. This could potentially worsen the relations with china and becoming a norm in how foreign owned digital platforms are handled

By seeking a pause, Trump is signalling that the game has changed from his presidency in 2020 when he tried to outright ban TikTok. Stating so does not alter the fact that more attention is given to the issue of national security as well as certain political and economic considerations as to the free market.

Trump’s TikTok Shift: Meeting with CEO Amid Calls for Ban

This comes when President-elect Trump invited TikTok’s Chief Executive Officer, TT Shou Zi Chew for a meeting in December, days after boasting about his newly found ‘warm’ feeling for the application. Trump said he would prefer that Tik Tok continues to operate in the United States for at least little while, this was a result of the billions of views that he got on the application during his campaigns.

TikTok has not provided comment on these new events; however, the business has maintained for quite some time that it is safe in the United States and apart from Chinese control. TikTok has been adamant that user data and recommendation algorithms are hosted and processed within the country on Oracle servers and decisions regarding the moderation of TikTok content as far as using it are concerned are processed within the United States.

First Amendment absolutists have also gotten involved in cases, filing amicus briefs to the Supreme Court claiming that a TikTok ban is authoritarian state-like censorship. Others have warned, that such action could resonate on the topic of freedom of speech and access to information at large.

TikTok, though, remains a point of concern within the U.S. Justice Department, and for many lawmakers, having a TikTok owned by a Chinese company constitutes a constant threat to the country’s security. This position raises tensions over previous fears that have been made concerning data access and control by the Chinese government regardless of TikTok’s stance.

Adding to the pressure, Montana Attorney General Austin Knudsen filed a Supreme Court brief for a coalition of 22 attorneys general for the divest-or-ban legislation needed. Still, with the issue to be debated at the Supreme Court level, the remaining fate of TikTok remains unclear within the American political, security and liberty standard.
